This
Indenture made the Thirtieth day of August, in the year of our lord one
thousand eight hundred and sixty-four, between Henry Young, of Pickadilly on or
near the Bay of Saint George, on the island of Newfoundland, Yeoman, and Susan
Wife of the said Henry Young, Amelia Young, of said place, widow, and Martha
Young, of Red Island in the said Bay of Saint George, and island of
Newfoundland aforesaid, widow of the one part, and Michael Cokely, of the township
of North Sydney in the county of Cape Breton and province of Nova Scotia,
Yeoman, of the other part, Witnesseth that whereas Gabriel Young, late of the
French Village in the county aforesaid, Yeoman, deceased, died, seized and possessed
in fee simple of the Lands and premises hereinafter and described, and his
children as heirs-at-law of the said Gabriel Young became and were
entitled
thereto; and whereas Sarah Cokely, wife of the above named Michael Cokely, and
relict of the above named Gabriel Young, as such became and is by law entitled
to Dower – being the occupancy of one third part of the Lands and premises
before mentioned; and the said Henry Young, Amelia Young, and Martha Young
being the children of the said Gabriel Young and entitled to an equal share of
the said Property are willing to transfer to the said Michael Cokely their
several interests in the reversions of the said third part constituting the
said Dower. Now this Indenture witnesseth that in consideration of the premises
and in consideration of the sum of Eight dollars to each of them in hand paid
before the ensealing and delivery of these presents of good and lawful money,
the currency of Newfoundland aforesaid, and the receipt whereof is hereby
acknowledged they the said Henry Young and Susan Young his wife, Amelia Young,
and Martha Young have and each of them hath bargained, sold, transferred, made
over, released, confirmed and delivered up, and by
these
presents do and each of them doth grant, bargain, sell, transfer, make over,
release, confirm and deliver up, for themselves, their heirs, executors,
administrators and assigns, unto the said Michael Cokely, his heirs, executors,
administrators and assigns, all and sundry their right, title, interest,
property, claim and demand of, in and to the state in Dower of her the said
Sarah Cokely as now set off, meted and bounded to him the said Michael Cokely
and in his possession being the one-third part of the said Lot granted to the
said Gabriel Young and designated Number Seven, situated in the French Village
so called, and containing Two Hundred Acres more or less; together with all
buildings, fences, improvements, commodities, rents, issues, profits and emoluments, and all and
singular the appurtenance thereunto belonging or in any wise appertaining, To
Have and To Hold unto the said Michael Cokely, his heirs, executors,
administrators or assigns, and to his and their only proper use, benefits and be
hoof, forever. In witness whereof the parties to these Presents have hereunto set
their hands and affixed their seals the day and year first within their right,
title, interest, property, claim and demand of, in and to the Estate in Dower
of her the said Sarah Cokely as now set off, meted and bounded to him the said Michael Cokely and in his
possession being the one-third part of the said Lot granted to the said Gabriel
Young and designated Number Seven, situated in the French Village so called,
